Article 1 — Scope of Application of the General Terms and Conditions of Sale

This site is published by SARL ODYSSEUS - PARISIENNE, with a share capital of 179 928,00 €, whose registered office is located at RIOM (63200), 1 rue Pierre et Marie Curie, registered with the RCS of Clermont-Ferrand under number 319850830.

These general terms and conditions of sale apply to all orders placed on or through the website www.tendance-parfums.com. They apply exclusively to natural persons acting as consumers (hereinafter referred to as the Customer), who are of legal age and have the legal capacity to enter into contracts.

The tendance-parfums.com website offers the Customer the sale of all products relating to perfumery, cosmetics, and beauty products.

Prior to placing an order, the Customer declares that the purchase of these products is intended for use unrelated to their professional activity.

Placing an order on the website https://www.tendance-parfums.com/ implies that the Customer has read and agreed to the entirety of these general terms and conditions of sale. Tendance Parfums reserves the right to adapt or modify these general terms and conditions of sale at any time. In such a case, only the general terms and conditions of sale in force at the time the order is placed shall apply.

The date of the last update is indicated at the top of this document. Tendance Parfums advises the Customer to save and/or print these general terms and conditions of sale for safe and lasting retention, so that they may be invoked at any time during the performance of the contract should the need arise.

Throughout this document, the Customer shall be understood as the party with whom the purchase-sale relationship is established and who will be invoiced in respect of the order.

Article 2 — Price

2.1. All prices of products offered for sale on the website https://www.tendance-parfums.com/ are expressed in euros inclusive of all taxes, excluding any contribution towards shipping costs. These shipping costs are available for consultation below.

2.2. Tendance Parfums reserves the right to modify its prices at any time (in particular in the event of a VAT increase) but undertakes to apply the rates in force at the time the order is registered, subject to the availability of the products at that date.

2.3. Products remain the property of Tendance Parfums until the price has been paid in full. However, from the moment the order is collected or received by the customer or their representative, the risks relating to the goods collected or delivered are transferred to the customer.

2.4. Shipping costs will be communicated in addition to the product price.

Article 3 — Orders — Order Validation

3.1. Orders are placed on the website https://www.tendance-parfums.com/

3.2. Contractual information is presented in French.

3.3. Products are offered for sale in metropolitan France, Corsica, Monaco, Belgium and the European Union.

3.4. To place an order, the Customer follows the various order steps displayed on the website, namely:

  • the selection of the chosen item(s) via the “my basket” section,
  • Customer identification via the “my account” section,
  • the delivery terms and conditions via the “delivery” section,
  • the payment terms via the “payment” section,
  • the finalisation of the order via the “confirmation” section.

3.5. The Customer's attention is particularly drawn to the method of acceptance of orders placed on the website www.tendance-parfums.com. The « double click » and the checkbox confirming that the general terms and conditions of sale have been read and accepted, validating the order, constitutes an « electronic signature » and is equivalent to a handwritten signature. These actions constitute an irrevocable and unconditional acceptance of the order by the Customer. Unless proven otherwise, the data recorded by Tendance Parfums on the Internet constitutes proof of all transactions entered into between the company and its customers.

3.6. The contractual information relating to the order (including in particular the order number) will be confirmed by e-mail in due course and at the latest at the time of delivery/dispatch. Tendance Parfums strongly advises the Customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is made available to the Customer in the « my account » section.

3.7. The information provided by the Customer when placing the order (in particular the name and delivery address) is binding upon them. Accordingly, Tendance Parfums shall under no circumstances be held liable in the event that an error made when placing the order prevents or delays delivery.

3.8. Tendance Parfums reserves the right to refuse any order from a customer with whom a dispute exists or has existed regarding the payment of a previous order placed with Tendance Parfums.

3.9. The Customer declares that they have full legal capacity to be bound by these general terms and conditions of sale.

Article 4 — Availability

4.1. Product and price offers are valid for as long as they are visible on the website, subject to available stock.

4.2. In the event that a product is unavailable after an order has been placed, the Customer will be informed of the timeframe within which the product will become available. A Customer who does not wish to wait for the product to become available, or in the event of the product being definitively unavailable, will be refunded the product price if their bank account has been debited, within 7 days of the effective payment date.

Article 5 — Payment

Orders are payable in full on the day the order is placed. Payment is made by bank card (CB, Visa, Mastercard, e-Carte Bleue) via the secure platform of LCL bank, or by PayPal — including, where applicable, the instalment payment option offered by PayPal.

An order will only be deemed accepted by Tendance Parfums once the relevant bank payment centres have given their approval and Tendance Parfums has validated the order against its risk acceptance criteria.

If the application is accepted by the payment centre and by Tendance Parfums, the customer will be informed by the sending of an order confirmation by e-mail.

If the application is refused, the order will be automatically declined and the customer will also be informed by e-mail.

Article 6 — Delivery

The delivery timeframe depends on the actual availability of the products at the time the order is placed. Products are delivered to the delivery address indicated by the customer on their order form. If the customer is absent, a delivery notice left by the carrier in their letterbox will invite them to contact the carrier to arrange a new delivery date, or to collect the parcel from the nearest post office.

Delivery is handled by two carriers, Colissimo (La Poste) and Mondial Relay, to a home address or to a collection point. Current rates are specified on the Delivery page of the website.

6.1. Standard Home Delivery via Colissimo

Delivery of the ordered and paid-for products to the address chosen by the Customer. This is carried out via the services of LA POSTE. Delivery will take place within an estimated timeframe of 2 to 3 working days from departure from the warehouse for any order placed before 14:00 at the latest from Monday to Tuesday, and before 10:00 on Saturday, subject to product availability.

6.1.1. Colissimo Home Delivery — without signature
Once your parcel has been prepared by us, it will be delivered within an estimated timeframe of 72 hours from its departure from the warehouse, directly to your letterbox. If your letterbox is not large enough and you are absent, a delivery notice will be left for you, allowing you to choose a new delivery date online within 6 working days, or to collect your parcel from the post office of your choice from the following day at 15:00.

No dispute regarding the delivery itself is possible if the parcel appears as having been delivered, as the computer tracking system (scanning) of La Poste shall be deemed conclusive.

6.1.2. Colissimo Home Delivery — with signature
Once your parcel has been prepared by us, it will be delivered within an estimated timeframe of 72 hours from its departure from the warehouse and handed over upon signature. If you are absent, a delivery notice will be left for you, allowing you to choose a new delivery date online within 6 working days, or to collect your parcel from the post office of your choice from the following day at 15:00.

6.2. Collection Point Delivery via Colissimo

Delivery of the ordered and paid-for products to the collection point selected by the Customer. This is carried out via the services of LA POSTE. Delivery will take place within an estimated timeframe of 48 working hours from departure from the warehouse for any order placed before 14:00 at the latest from Monday to Tuesday, and before 10:00 on Saturday, subject to product availability.

6.2.1. At La Poste: you may choose the branch at which you wish to have your parcel delivered from among the 10 000 post offices available throughout metropolitan France. You may then collect it within 10 working days. After this period, your parcel will be returned to us.

6.2.2. At a Pickup relay point: you may choose one of the 7 500 local retailers in the Pickup network from which you wish to collect your parcel. You may then collect it within 10 working days. After this period, your parcel will be returned to us.

6.2.3. At a Pickup Station locker: you may choose one of the 500 automated collection lockers to have your parcel delivered. Located along your route (train stations, metro, car parks, shopping centres, etc.), they are accessible 7 days a week, 24 hours a day. You will be notified of your parcel's availability by SMS and e-mail with your collection codes, for 3 working days. After this period, your parcel will be returned to us.

6.3. Delivery via Mondial Relay

The Customer may also opt for delivery via Mondial Relay, to the relay point of their choice, in France as well as in several European countries. The Customer is notified of the availability of their parcel by e-mail and SMS. The parcel remains available at the relay point for the period indicated by the carrier; after this period, it is returned to Tendance Parfums.

6.4. Delays & Force Majeure

Any delays shall not entitle the buyer to claim damages from Tendance Parfums. In any event, delivery within the agreed timeframes can only take place if the buyer is up to date with their obligations towards the seller. The following shall be considered as cases of force majeure releasing Tendance Parfums from its obligation to deliver: war, riot, fire, strikes, accidents, and the impossibility of being supplied, or any other cause beyond the seller's control.

6.5. Impossibility of Delivery

In the event of an incomplete address, an incorrect address, refusal of parcels by the recipient, or a lack of information resulting in the impossibility of delivering the product to the recipient in a timely manner, the website www.tendance-parfums.com cannot be held liable for failure to meet the delivery time slot and/or date. If such lack of information results in a second delivery attempt to the delivery address, the website shall be entitled to charge the customer the costs corresponding to this second delivery.

Article 7 — Conformity

7.1. The Customer must verify the conformity of the goods delivered or collected before signing any delivery document. In the event of any anomaly being noted, the Customer shall record their reservations directly on the delivery document, followed by their signature. In the event of a serious anomaly being noted (torn or open packaging, missing or damaged products, etc.), the Customer shall refuse the parcel and specify the reasons for their refusal on the delivery document.

The Customer must also confirm their reservations to the Tendance Parfums Customer Service (at the following address: Service Clientèle Tendance Parfums, 1 rue Pierre et Marie Curie, 63200 RIOM) within 3 working days of receiving the item(s). Any complaint submitted outside this period cannot be accepted.

7.2. Tendance Parfums undertakes to refund or exchange products that do not conform to the Customer's order. To do so, the Customer shall send, by e-mail, telephone, or post, to the Tendance Parfums Customer Service, 1 rue Pierre et Marie Curie, 63200 RIOM, within 30 days of delivery, any complaint relating to a product's non-conformity with their order. Tendance Parfums will also reimburse the return shipping costs.

7.3. The return of products can only be accepted for complete, unopened products in their original condition. Where the return results from a non-conformity, a preparation error, or a defective product attributable to Tendance Parfums, a prepaid return label is provided to the Customer: the return is therefore free of charge for the Customer.

Article 8 — Right of Withdrawal

8.1. The Customer is informed that they have a period of 30 full days, from the date of receipt of the products, to exercise their right of withdrawal without having to provide reasons or pay any penalties, except, where applicable, the return shipping costs. Where this period expires on a Saturday, Sunday, or a public holiday, it is extended to the next working day.

The refund is processed upon receipt and inspection of the returned product. It is automatically issued to the payment method used at the time of the order; depending on your bank, the refund will reach your account within a period of 24 hours to 10 days.

However, a return can only be accepted if the product is in perfect condition, namely in its original packaging and unopened. Items returned opened, damaged, or soiled by the Customer will be refused.

Return shipping costs, amounting to 7,50€, remain the responsibility of the Customer in the event of withdrawal. To exercise your right of withdrawal, initiate your return from your customer account, under the “My orders” section, or by contacting Customer Service. After paying the return costs online, a prepaid return label will be sent to you by e-mail. You may also notify us of your decision to withdraw by using the form below.

Article 9 — Security

The Customer's credit card information is protected by SSL encryption. This information is sent directly to the Tendance Parfums bank and therefore does not pass through or be stored on Tendance Parfums servers.

Article 10 — Intellectual Property

All texts, comments, works, illustrations, images and photographs, trademarks and databases reproduced and incorporated on the website www.tendance-parfums.com are protected worldwide, in particular under intellectual property law and copyright.

As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorised. Any total or partial reproduction of the website www.tendance-parfums.com is strictly prohibited.

Article 12 — Applicable Law and Disputes

12.1. These general terms and conditions of sale and the online sales contract are governed by French law. In the event of a dispute or complaint, the Customer is advised to contact Customer Service in order to seek and find an amicable resolution.

12.2. European online dispute resolution platform: https://ec.europa.eu/consumers/odr

12.3. CONSUMER MEDIATION SERVICE: Amicable resolution of disputes between the professional and the consumer in accordance with Articles L611-1 to L641-1 and R612-1 to R616-2 of the Consumer Code.

In the event of an unresolved dispute between the Professional and the Consumer, the consumer may refer the matter to the consumer mediator. Before referring to the mediator, the consumer must have already attempted to resolve their dispute directly with the professional by means of a written complaint. The procedure is free of charge for the consumer (R612-1 of the Consumer Code).

Any dispute relating to the existence, interpretation, performance or termination of the contract concluded between the Parties shall, in the absence of an amicable agreement, fall within the jurisdiction of the competent courts.

Article 13 — Personal Data

13.1. All information collected by Tendance Parfums from the Customer is subject to computer processing for the purpose of processing the online order. It may be used for commercial prospecting and promotional communications relating exclusively to the activities of Tendance Parfums.

In accordance with the Data Protection Act No. 78-17 of 6 January 1978, the Customer may at any time access the personal information held by Tendance Parfums concerning them, and request its modification or deletion by sending an electronic message or postal letter to the following address: Service Clientèle Tendance Parfums, 1 rue Pierre et Marie Curie, 63200 RIOM.

13.2. Existence of a telephone marketing opt-out register: If your telephone number is collected when you create your account or place your order, your telephone details will only be used for the proper fulfilment of your orders or to contact you to offer you new services. You may register free of charge on the telephone marketing opt-out list.
